Article 50: make the AI identity clear before the conversation starts
A practical guide to AI disclosure in sales conversations, and why a privacy policy alone is not enough.
AI-assisted editorial · Sources checked 9 October 2026
A buyer should know who is speaking
A sales agent can research an account, prepare a message, and answer a buyer. Those are different activities. Treating them as one legal category creates confusion for teams and recipients.
The useful starting question is simple: is a person receiving a human-controlled message, or directly interacting with an AI system?
What Article 50 covers
Article 50(1) addresses AI systems that interact directly with people. Providers must design the system so people are informed of that interaction, unless it is obvious in the circumstances. Article 50(5) requires clear, distinguishable information by the first interaction or exposure.
The Commission says Article 50 applies from 2 August 2026. Its guidance distinguishes direct AI interaction from background assistance and communication through a human intermediary.
Other paragraphs address machine-readable marking of generated content and disclosure for certain uses, including deepfakes. The duties differ by system, output, and the organisation’s role. One sentence in an email is not a complete Article 50 assessment.
Start with the conversation, not the footer
Our operational recommendation is to introduce an AI sales agent before asking the buyer to engage. A disclosure hidden behind a privacy link makes the recipient do the work of discovering who is speaking.
For an AI-led conversation, a possible opening is: “I’m Nora, Avelia’s AI sales assistant.” Then explain the reason for contacting the person. Keep the introduction brief and use the language of the conversation.
This is a writing example, not a universal legal formula. The right presentation depends on the channel and actual interaction.
Separate three sales scenarios
A person uses AI to draft a message, checks it, and sends it as their own communication. Assess that assistive workflow on its facts.
An AI agent replies directly to a buyer. Make the AI identity clear where the direct-interaction duty applies.
An AI voice agent calls a prospect. Put the introduction at the start of the audible conversation; a website notice cannot replace a spoken experience.
Human approval of a campaign does not automatically make every later AI interaction a human conversation.
Check the handoff as well as the opening
A good experience lets the buyer understand who will answer next. If a person takes over, say so. If the agent cannot answer, offer a real route to the team rather than inventing certainty.
Test the first message, first reply, call opening, and handoff separately. Read or listen as a recipient would. A setting labelled “disclosure enabled” is weaker evidence than the actual message delivered.
Transparency is part of the offer
Avelia’s position is that AI should help a sales team act with context and clear boundaries. The buyer should not have to guess whether Nora is a person.
Use Article 50 as a prompt to design a better conversation, while assessing data protection and outreach permissions separately. This article explains an operational approach; it does not certify a deployment’s compliance.
